MOTION FOR TRAVEL FUNDS

The defendant, James Montague, by and through his attorneys, James K. Bredar, Federal Public Defender for the District of Maryland, and Larry A. Nathans, Supervisory Assistant Federal Defender moves this Court to enter an Order, pursuant to 18 U.S.C. § 4285, directing the Office of the United States Marshal to provide funds for Mr. Montague's travel and subsistence expense from his residence in Baltimore, Maryland to the Federal Correctional Institution at Morgantown, West Virginia. The reasons for this request are set forth below:

1. Mr. Montague has been declared to be indigent by this Court..

3. Mr. Montague was sentenced by this Court on January 8, 1993 to a term of three months imprisonment.

4. Mr. Montague is presently scheduled to report to the Federal Correctional Institution at Morgantown, West Virginia no later than February 22, 1993 at 2:00 p.m.

5. Mr. Montague does not possess the necessary funds to travel to the Federal Correctional Institution at Morgantown, West Virginia.



6. Mr. Montague presently resides at 1502 Smallwood Street, Baltimore, Maryland 21216. His telephone number is (410) 225-9909.

WHEREFORE, Mr. Montague respectfully requests this Court to enter an Order directing the Office of the United States Marshal to pay for Mr. Montague's travel and subsistence expenses from his residence in Baltimore, Maryland to the Federal Correctional Institution at Morgantown, West Virginia.

Upon consideration of Mr. Montague's motion for payment of expenses by the United States Marshal's Service, it appearing that Ms. Montague is financially unable to afford the necessary expenses to travel to his designated place of incarceration at the Federal Correctional Institution at Morgantown, West Virginia it is, this ______ day of February, 1993:
