This appeal arises from a criminal prosecution of defendant-appellant Brad K. xxxxxxx by plaintiff-appellee, the United States of America. There are no intervenors or amici.
B. Rulings Under Review:
This is an appeal from the judgment of the district court (the Honorable Thomas F. Hogan), dated March 7, 2000, imposing sentence after conviction for possession with intent to distribute cocaine base within 1,000 feet of a school in violation of 21 U.S.C. 860(a).
In this appeal, appellant seeks review of the district court's denial of appellant's motion to suppress evidence on September 10, 1999 and September 13, 1999. Appellant also seeks review of the district court's denial of his motion for judgment of acquittal on the "school yard" charge (21 U.S.C. 860(a)) and the court's denial of his request for a jury instruction defining the types of protected schools for purposes of 21 U.S.C. 860(a).
