If the Court imposes a prison sentence of more than 1 year,

The Court shall impose a term of supervised release of 3 years |
If the maximum term of imprisonment authorized for the offense of conviction is more than 1 year but less than 25 years. |
If the Court imposes a sentence of 1 year or less, |
The Court shall impose a term of supervised release not to exceed 5 years |
If the maximum term of imprisonment authorized for the offense of conviction is 25 years or more. |
If the Court imposes a sentence of 1 year or less, |
The Court shall impose a term of supervised release not to exceed 3 years |
If the maximum term of imprisonment authorized for the offense of conviction is more than 1 year but less than 25 years. |
SEX OFFENSES (where registration is required) |
Notwithstanding the above, the Court may, in its discretion: |
Impose a longer term up to 10 years, or up to life if the person is required to register for life. |
Not more than 5 years |
If the maximum term of imprisonment authorized for the offense is life or the offense is specifically designated as a AClass A @ felony. |
Not more than 3 years |
If the maximum term of imprisonment authorized is 25 years or more, but less than life |
Not more than 2 years |
If the maximum term of imprisonment authorized for the offense is 5 years or more, but less than 25 years |
Not more than 1 year |
If the maximum term of imprisonment authorized for the offense is less than 5 years. |
SEX OFFENSES |
Revocation operates the same as for any other offense. |
*If the maximum term of imprisonment authorized for an offense is a term of years, the court may impose a determinate sentence up to the statutory maximum authorized minus the maximum term of imprisonment authorized upon revocation of supervised release.
*If the maximum term of imprisonment authorized for the offense is up to life or if an offense is specifically designated a Class A felony, the court shall not deduct the maximum revocation time from the maximum term of imprisonment authorized when imposing the prison sentence.
