SUPERVISED RELEASE:

OFFENSES COMMITTED ON OR AFTER 8/5/2000

Length of Supervised Release

If the Court imposes a prison sentence of more than 1 year

 

The Court shall impose a term of supervised release of 5 years

If the maximum term of imprisonment authorized for the offense of conviction is 25 years or more.

If the Court imposes a sentence of more than 1 year,

The Court shall impose a term of supervised release of 3 years

If the maximum term of imprisonment authorized for the offense of conviction is more than 1 year but less than 25 years.

If the Court imposes a sentence of 1 year or less,

The Court shall impose a term of supervised release not to exceed 5 years

If the maximum term of imprisonment authorized for the offense of conviction is 25 years or more.

If the Court imposes a sentence of 1 year or less,

The Court shall impose a term of supervised release not to exceed 3 years

If the maximum term of imprisonment authorized for the offense of conviction is more than 1 year but less than 25 years.

SEX OFFENSES

(where registration is required)

Notwithstanding the above, the Court may, in its discretion:

Impose a longer term up to 10 years, or up to life if the person is required to register for life.

Revocation of Supervised Release

Not more than 5 years

If the maximum term of imprisonment authorized for the offense is life or the offense is specifically designated as a AClass A @ felony.

Not more than 3 years

If the maximum term of imprisonment authorized is 25 years or more, but less than life

Not more than 2 years

If the maximum term of imprisonment authorized for the offense is 5 years or more, but less than 25 years

Not more than 1 year

If the maximum term of imprisonment authorized for the offense is less than 5 years.

SEX OFFENSES

Revocation operates the same as for any other offense.



*If the maximum term of imprisonment authorized for an offense is a term of years, the court may impose a determinate sentence up to the statutory maximum authorized minus the maximum term of imprisonment authorized upon revocation of supervised release.

 

*If the maximum term of imprisonment authorized for the offense is up to life or if an offense is specifically designated a Class A felony, the court shall not deduct the maximum revocation time from the maximum term of imprisonment authorized when imposing the prison sentence.
