MEMORANDUM IN SUPPORT OF MOTION
Count One (1) of the Indictment herein alleges a conspiracy and if the Government intends to introduce into evidence in this case statements of any co-conspirator, indicted or unindicted, then and in that event, Defendant is entitled to a preliminary factual determination of the statements admissibility against him. Bourjaily v. United States, 483 U.S. 171, 107 S.Ct. 2775 (1987). This preliminary determination requires a pretrial hearing wherein the Government must establish (a) the existence of a conspiracy; (b) the statements were made during the course and in furtherance of the alleged conspiracy; and (c) Defendant was a member of the alleged conspiracy. United States v. James, 590 F.2d 575 (5th Cir. 1979).
