ORDER FINDING DEFENDANT NOT GUILTY
ONLY BY REASON OF
INSANITY
After a full hearing of the facts and a thorough review of the psychological report prepared by Dr. Neil Blumberg and upon hearing argument of counsel, it is hereby:
ORDERED, in open Court, this day of April, 1992, in Criminal Case No. xxxxxxxxxx, that:
1. Mr. xxxxxxxx is found, pursuant to 18 U.S.C. § 4242(b)(3), not guilty only by reason of insanity;
2. Pursuant to 18 U.S.C. § 4243(a), Mr. xxxxxxxx shall be committed to a suitable facility until such time as he is eligible for release pursuant to 18 U.S.C. § 4243(e);
3. Mr. xxxxxxxx is suffering from a mental disease or defect as a result of which his release would create a substantial risk of bodily injury to another person, or serious damage to the property of another, pursuant to 18 U.S.C. § 4243(c) and (d), and 18 U.S.C. § 4247(c)(4)(C);
4. Mr. xxxxxxxx is committed to the custody of the Attorney General in accordance with the provisions of 18 U.S.C. § 4243(e); and
5. Mr. xxxxxxxx shall not be discharged until such time that it is determined that he has recovered from his mental disease or defect to such an extent that his release, or his conditional release, would no longer create a risk of bodily injury to another person or serious damage of the property of another in accordance with the procedures outlined in 18 U.S.C. § 4243(f).
6. It is recommended by the Court that Mr. xxxxxxxx be designated to the Federal Medical Center at Rochester, Minnesota.
