xxxxxxxxxx was indicted by a federal grand jury on February 23, 1993 for False Statements in Connection with Loan in violation of 18 U.S.C. 1014 and Bank Fraud (six counts) in violation of 18 U.S.C. 1344. He will have a jury trial on these charges in the United States District Court. Through counsel, he has moved this court for an order allowing his inspection of jury records.
A defendant in a federal criminal case has a constitutional and statutory right to a grand jury and petit jury chosen without discrimination, and which represent a fair cross-section of the community. Glasser v. United States, 315 U.S. 60 (1942); Smith v. Texas, 311 U.S. 128 (1940); United States v. Bulera, 420 F.2d 564 (1st Cir. 1970); 28 U.S.C. 1661.
The provisions of the Jury Selection and Service Act of 1968 allow the parties in a case the unqualified right to inspect the jury list at all reasonable times during the preparation of a motion to challenge compliance with the jury selection procedure. Test v. United States, 420 U.S. 28 (1975); United States v. Beaty, 465 F.2d 1376 (9th Cir. 1972); 28 U.S.C. 1967(f).
